Terms of Service

1. Acceptance

By creating a WaAI account or using the WaAI platform, you agree to these Terms of Service. If you are registering on behalf of a business, you confirm you have authority to bind that business to these terms. If you do not agree, do not use WaAI.

2. The Service

WaAI provides an AI-powered WhatsApp automation platform that allows businesses to automate customer interactions including bookings, orders, FAQs, and cancellations. The service requires you to connect an existing WhatsApp number via QR scan using the Baileys library.

3. Account Registration

  • You must provide accurate business information at registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old and have legal authority to operate a business in the UAE.
  • One account per business entity unless you subscribe to a multi-branch plan.

4. Acceptable Use

You agree to use WaAI only for legitimate business communication with customers who have consented to receive messages from your WhatsApp number. You must not:

  • Use WaAI to send unsolicited bulk messages or spam.
  • Automate communications that violate WhatsApp's Terms of Service.
  • Use the platform for illegal, fraudulent, or deceptive purposes.
  • Attempt to reverse-engineer or exploit the WaAI platform.
  • Share your account credentials with third parties.

5. Subscription and Billing

WaAI offers monthly subscription plans (Starter: AED 149/mo, Growth: AED 349/mo, Enterprise: custom). All prices are in UAE Dirhams (AED) and exclusive of VAT. Your subscription renews automatically each month. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

6. Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, you must subscribe to continue using the service. Trial data is preserved if you subscribe within 7 days of trial expiry.

7. Service Availability

We target 99.5% monthly uptime for the WaAI API and dashboard. Planned maintenance will be communicated at least 24 hours in advance. We are not liable for WhatsApp network outages or changes to WhatsApp's platform that affect service delivery.

8. Intellectual Property

WaAI and all associated software, designs, and content are owned by WaAI and protected by UAE and international IP law. You retain ownership of your business data and customer data. You grant WaAI a limited licence to process your data solely to deliver the service.

9. Limitation of Liability

WaAI's total liability to you for any claim arising from these terms shall not exceed the fees you paid in the 3 months prior to the claim. We are not liable for indirect, consequential, or loss-of-profit damages. We are not liable for missed bookings caused by WhatsApp connectivity issues outside our control.

10. Termination

We may suspend or terminate your account immediately if you breach these terms, engage in fraudulent activity, or if your WhatsApp usage violates Meta's policies. You may terminate your account at any time from your dashboard settings.

11. Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved in the courts of Dubai, UAE.

12. Changes

We will notify you of material changes to these terms at least 14 days before they take effect. Continued use of WaAI after changes take effect constitutes acceptance.
